These Terms of Sale govern the purchase of original artworks offered for sale on this website (the "Site") by OMOO ("we", "us", "the Artist"). By placing an order you agree to these terms. Please read them together with our Privacy Policy and Shipping & Returns information.
Artworks on this Site are sold directly by the Artist, OMOO. For any question about an order you can contact us through the contact form or by email at the address shown there.

Every work offered is an original, one-of-a-kind piece created by the Artist. As each work is unique, once a piece is sold it is no longer available. We make every effort to display colours and details accurately, but the actual appearance may vary slightly due to your screen settings, photography and the handmade nature of the work. Dimensions are stated for each work in centimetres.
Prices are shown in euro (EUR) on each artwork page and include standard shipping (see Section 6 and our Shipping & Returns page). The price shown at the moment you complete your order is the price that applies.
Prices are the total price payable for the artwork and include standard shipping. Any import duties or taxes that may apply in the destination country are not included and are the buyer's responsibility (see Section 6 and our Shipping & Returns page). When you select "Buy" on an artwork and complete the checkout, you make an offer to purchase that work. Payment is processed securely by our payment provider, Stripe. We do not see or store your full card details. Your purchase is confirmed once payment has been successfully received, at which point a contract of sale is formed and the work is marked as sold.
We reserve the right to decline or cancel an order in exceptional cases (for example, an obvious pricing error, a work that is no longer available, or suspected fraud). If we cancel an order for which you have already paid, you will receive a full refund.
We accept the payment methods presented at checkout through Stripe. By paying, you confirm that you are authorised to use the chosen payment method. Payment is taken at the time of purchase.
Standard shipping is included in the price of each artwork. We ship internationally to the countries available at checkout. Works are packed by hand with care appropriate to original art. Estimated dispatch and delivery times, and information about possible customs or import duties for international deliveries, are described on our Shipping & Returns page.
Risk of loss or damage passes to you upon delivery. If a work arrives damaged, contact us promptly (see Section 8).
Because each artwork is an original, one-of-a-kind piece, please consider your purchase carefully before ordering. This Returns Policy (返品特約) sets out when a return is accepted.
Change of mind: [OMOO: state your policy here. For example, either "we are unable to accept returns or exchanges for change of mind on original artworks", or "change-of-mind returns are accepted within X days of delivery, with return shipping paid by the buyer, provided the work is returned undamaged in its original packaging". If you do not state a policy, Japanese law (the Specified Commercial Transactions Act) generally requires returns to be accepted within 8 days of delivery, so it is important to decide and state this clearly.]
Damaged, defective, or not as described: if your artwork arrives damaged or is not as described, you are entitled to a remedy. Contact us promptly (see Section 8) with photographs and your order reference, and we will arrange a replacement where possible or a refund. Return shipping in these cases is at our expense.

As a consumer you benefit from the legal guarantee of conformity provided by applicable law. If a work arrives damaged, defective, or not as described, please contact us promptly with photographs and your order reference. We will work with you to arrange a repair, replacement where possible, or refund in accordance with your legal rights. Returns of damaged or non-conforming works are at our expense.
Ownership of the physical artwork transfers to you once full payment has been received and the work has been delivered. Copyright and all reproduction rights remain with the Artist. Purchase of a work does not grant any right to reproduce, copy, or commercially exploit the image of the work. You may not use images of the work for commercial purposes without the Artist's written permission.
Nothing in these terms limits your statutory rights as a consumer or our liability for matters that cannot be excluded by law. Subject to that, our liability in connection with a purchase is limited to the price paid for the artwork.
These Terms of Sale are governed by the laws of Japan. [OMOO: confirm the governing law and the competent court with a professional in Japan if you wish to specify one.]
We may update these Terms of Sale from time to time. The version in force at the time of your order is the one that applies. Any changes will be reflected in the "Last updated" date above.
